INTRODUCTION

DENCARE MANAGEMENT INC. Online Backup’s software and servers use AES encryption, and your data is encrypted on your machine before it is stored by DENCARE MANAGEMENT INC.. Data is encrypted at all times while stored by DENCARE MANAGEMENT INC..
Users selecting DENCARE MANAGEMENT INC. Ultra Safe must retain their account name and password in a secure location such as a safe deposit box. Data that is transferred using Ultra Safe cannot be accessed by DENCARE MANAGEMENT INC. and if a user loses his password, the data cannot be accessed.
DENCARE MANAGEMENT INC. EULA follows a simple and direct privacy policy. DENCARE MANAGEMENT INC. does not share account information with anyone except as required by law. (DENCARE MANAGEMENT INC. cannot access data stored with Ultra Safe even with a Court order; the data is encrypted and the correct password must be supplied to access the data.) Billing data is maintained securely by DENCARE MANAGEMENT INC.’s billing partner.
DENCARE MANAGEMENT INC. also maintains deleted files unless specifically deleted by the user. DENCARE MANAGEMENT INC. also maintains all versions of the file that were sent by the user to the DENCARE MANAGEMENT INC. Infiscale servers.
DENCARE MANAGEMENT INC. provides a 99.9% data access service level agreement (SLA).
DENCARE MANAGEMENT INC. data centers are Tier III and Tier IV level certified by The Uptime Institute.
DENCARE MANAGEMENT INC. provides an additional level of assurance that is not otherwise available from other backup services. All data is replicated in two data centers, eliminating data centers as a single point of failure. Competitors SLA’s are premised on the performance of a single data center.
SPECIFIC REGULATIONS

HIPAA

DENCARE MANAGEMENT INC. Online Backup when used with Ultra Safe complies with the record backup requirement and privacy requirements of HIPAA. No additional contract is required with DENCARE MANAGEMENT INC.. A longer certification is available on request.

HIPAA Statement

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) was the result of efforts by the federal government to ensure healthcare data practices permitted ease for patients to move jobs, insurance and healthcare providers.
As defined by 45 CFR 164.312 of HHS HIPAA, DENCARE Management Inc. (DenCare) Online Backup assist healthcare providers to be HIPAA compliant in the following ways:
DENCARE Online Backup, in all cases, creates, receives and transmits only encrypted data. DENCARE uses a three-tiered AES encryption system which encrypts data on the users computer, again in transit and finally when at rest in storage at DENCAREs datacenters.
This data cannot be read while in transit, or even on the DENCARE servers, as long as the user (health care provider) does not compromise the password (for example, writing the password on a sticky note and attaching it to a computer screen in open view.)
·         DENCARE servers are located in SAS 70 II datacenters protected by gated access, 24 x 7 x 365 on-site staffed security and technicians, electronic card key access, and strategically placed security cameras both inside and outside the building.
·         DENCARE Online Backup is an automated offsite backup and protects data against hardware malfunction, accidental deletion, virus attacks, theft and natural disasters.
·         DENCAREs Ultrasafe allows the user (health care provider) to store their data securely such that no one including DENCARE engineers will be able to access their data.

A business associate agreement is not required with DENCARE. These agreements are between covered entities where there IS a reasonable probability that Protected Health Information can be reviewed.
Privacy regulations contained in HIPAA apply to Electronic Private Health Information and DENCARE does not possess this.
As DENCARE cannot and does not examine the data, no business associate agreement is required.
